RULES & REGULATIONS FOR MIX FM ARTIST OF THE MONTH: <B>CHARICE</B>''S ALBUM 1. Eligibility: No purchase or payment is required to participate in this contest. The said contest is open to all registered users of Mix.fm ("User") other than the employees of Airtime Management & Programming Sdn Bhd ("AMP") and their associated agencies and immediate families. The Contest Administrator is Airtime Management & Programming Sdn. Bhd. To register as a User, simply complete the epass registration form. However, an existing epass User may directly enter his/her user name and password when prompted to enter the Contest. Only one entry per User is permitted. All duplicate entries will be automatically disqualified or removed prior to the prize draw. 2. Contest Period: This contest will open on 01-July-2010 and close at 12 midnight, 31-July-2010. Entries received after the stipulated time will be ineligible for the prize draw. 3. Entry: By participating in this contest, the participant agrees to a full and unconditional agreement to and acceptance of these Rules and Regulations. All entries become the property of the Contest Administrator and may be used for marketing purposes by the Contest Administrator. All information furnished by the participants may be released to AMP. 4. Prizes: Prizes are not exchangeable for cash and not transferable. The Contest Administrator reserves the right to change the prizes without notice so long as it is equivalent or greater in value. The prizes are subject to the current terms and conditions as may be imposed by the Contest Administrator from time to time. Each winner is entitled to one prize only. 5. Drawing: Winners will be determined at the sole discretion of the Contest Administrator by the best slogans for the month from all eligible entries with correct answers received. The judge''''''''s decision is final and binding. No correspondences will be entertained. 6. Notification : All winners will be notified via email at the email address as provided in the online registration form. Users are personally responsible for ensuring that their profiles are updated and their names and email addresses have been accurately submitted to the Contest Administrator. The Contest Administrator and AMP shall not be held responsible or liable for any late, misdirected, lost or unsuccessful efforts to notify winners. The winner will have five (5) working days (Monday to Friday excluding public holidays) from the date of notification to indicate acceptance of the prize, failing which, the prize will be forfeited. 7. Prize Collection: Upon successful verification by the Contest Administrator of the user name, password, personal profile and email address of the winner, the prize will be mailed to the winners. The Contest Administrator expressly disclaims any and all liabilities arising from any lost or unsuccessful transmission of the prizes. All winners hereby agree to the use of his/her name for the purpose of advertising, trade or promotion by the Contest Administrator or AMP without additional compensation. 8. Disclaimers: By entering the Contest, each User agrees that the Contest Administrator, AMP, its respective employees, officers, directors, agents, affiliates, parent, subsidiaries and representatives ("Contest Sponsors") shall not be liable or responsible for damages, losses, injuries, rights, claims or actions of any kind in connection with the Contest, or resulting from acceptance, possession, use/misuse of prizes, or participation in the Contest, including without limitation, personal injury, death, property damage and claims based on publicity rights, defamation or invasion of privacy. Each participant/User further agrees that the Contest Sponsors will not be responsible or liable for any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, duplicated or otherwise not in compliance with these Rules and Regulations. Contest Sponsors are not and will not be responsible or liable for any injury or damage to the User''s or to any other person''s computer relating to or resulting from entering or downloading materials in connection with this Contest. Contest Sponsors are not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission due to technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, communications line failure, server failure, or failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications caused by the User or by any of the equipment or programming associated with or utilised in this Contest or traffic congestion on the Internet or at any Web site, or by any human error which may occur in the processing of the entries in this Contest, or any combination thereof. 9. Submission of Unlawful Material. Individuals or Users should not submit Unlawful Material in the course of participating in the Contest, or use the Contest or AMP to upload, post, email, transmit or otherwise make available such Unlawful Material. "Unlawful Material" shall include (but not be limited to) any sexually explicit material or any material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another''s privacy, hateful, or racially, ethnically, or otherwise objectionable or infringes any patent, trademark, trade secret, copyright or other proprietary rights of another. The Contest Administrator reserves the right, in its sole discretion, to disqualify any such individual or User, and to bar the individual or User from participating in any other AMP contest or promotions, permanently or for such period of time as the Contest Administrator shall decide. No correspondence shall be entertained. 10. Disqualification: The Contest Administrator reserves the right at its sole discretion to disqualify any individual that it determines to be tampering with the entry process or the operation of the Contest or site, to be acting in breach or potential breach of these Rules and Regulations. No correspondence shall be entertained. The Contest Administrator further reserves the right to cancel, modify, suspend or delay the Contest in the event of unforeseen circumstances beyond its reasonable control. 11. General Terms and Conditions: The laws of Malaysia shall govern this Contest. This Contest is void where prohibited or restricted by any local, national, state, or any governmental laws. This Contest is also subject to these Rules and Regulations.
